Sales contract for companion (non-breeding) French Bulldog

All parties identified and referred to as Breeders/ Sellers, and Buyer, voluntarily enter into and agree to all terms stated in this contract as witnessed by their signatures. The terms within this agreement are intended to benefit and maintain the French Bulldog, the Breeder/Seller’s reputation and bloodlines, and the Buyer. The ownership of this French Bulldog is based on the conditions that all terms in this contract are met and followed. If the conditions of this contract are not met or followed, ownership will revert back to the Seller.

The following constitutes a sales agreement between the Breeders/ Sellers, Kathi Liebe, and the Buyer(s), , regarding the above described French Bulldog. These terms are entered into and agreed upon by all parties.
This puppy/ dog is sold for the purchase price of $_________, and must be spayed/neutered.
This puppy/ dog is sold as a “companion” French Bulldog and is NOT to be used for the purpose of breeding or showing in any conformation or breed ring competitions. He/ she is a companion animal, and may be used in obedience or agility competitions if the Buyer so chooses.
Buyer(s), please read and initial next to each of the terms listed below. This contract will be null and void if this is not completed.
________ The Buyer(s) will immediately notify the Breeders/ Sellers of any change in address, phone, or email.
__________ This puppy will live as a pet and member of the Buyer’s family, and will live in the Buyer’s residence. At no time should this dog ever be housed or chained outdoors.
________ If for any reason during the lifetime of this French Bulldog, the Buyer(s) is unable to keep this dog, the Buyer(s) will advise the Breeders/ Sellers. The Breeders/ Sellers will either help the Buyer(s) to place this puppy in a new suitable home, or the puppy/dog will return to the Breeders/ Sellers.
__________ At no time will this puppy be abandoned, sold to a third party, or placed in any rescue, shelter, or animal testing facility or lab.
________ The Buyer(s) agrees to socialize, train, and keep the puppy in a manner acceptable to the Breeders/ Sellers.
________ The Buyer(s) understands that not all veterinarians are created equal, and will make every attempt to locate and use a reputable veterinarian that is competent in the French Bulldog/brachycephalic breed.
________ The Buyer(s) claims NOT to be an agent of any pet shop, puppy broker, commercial breeding kennel, or animal laboratory.
Breeders/ Sellers commitments to the Buyer(s)
The Breeders/ Sellers agree to make the following commitments and guarantees to the Buyer(s);
•The Breeders/ Sellers guarantee that this French Bulldog is a purebred, and is registrable with the American Kennel Club.
•The Breeders/ Sellers guarantee that this French Bulldog is the offspring of the identified sire and dam, and that all pedigrees are true and accurate.
•The Breeders/ Sellers shall be available to the Buyer(s) to educate and train the Buyer(s) in regards to how best to care for this French Bulldog in a safe, healthy, and loving environment.
•The Breeders/ Sellers shall be available for advice in regards to any diet, behavior, or health concerns the Buyer(s) may have.
•The Breeders/ Sellers shall furnish all possible help and advise necessary to the Buyer(s) in the event the Buyer(s) may no longer be available or able to love and care for this French Bulldog, and a new home is needed.
•The Breeders/ Sellers shall make every effort to help the Buyer(s) locate a reputable veterinarian that is competent in understanding and treating the French Bulldog breed.
HEALTH GUARANTEES and replacement warranty:
To the best of the Breeders/ Seller’s knowledge, this French Bulldog is free of contagious disease and has been delivered to the Buyer(s) with vaccinations and de-worming appropriate for it’s age.
At the option of the Buyer(s), and at the Buyer(s) expense, the puppy/dog should be taken to the Buyer’s veterinarian within seventy-two (72) hours of the Buyer’s possession of the animal. The Buyer(s) has the privilege of returning the puppy/dog to the Breeders/ Sellers for a refund, not to exceed the purchase price, within that time period if the veterinarian certifies through diagnostic evaluation, and provides evidence of such in writing, that the French Bulldog is suffering from a debilitating illness. Any and all transportation charges are the responsibility of the Buyer(s).
Should this French Bulldog develop any GENETIC/ HEREDITARY disorder that would severely shorten the longevity, within one (1) year of purchase, the Breeders/ Sellers will refund the original purchase price, or replace the French Bulldog at the Breeders/ Seller’s discretion, upon the following conditions;
•The Buyer(s) will provide the Breeders/ Sellers and the Breeders/ Seller’s veterinarian with the necessary documentation, test results, and diagnostic evaluations.
•This puppy/dog will be returned to the Breeders/ Sellers at the Buyer(s) expense.
•All registration and ownership papers must accompany the French Bulldog.
Should this puppy/dog die within one (1) year of purchase date due to a GENETIC/ HEREDITARY condition, The Breeders/ Sellers will replace the French Bulldog for the Buyer under the following conditions;
•A necropsy must be performed by a licensed veterinarian and the report must be forwarded to the Breeders/ Sellers and the Breeders/ Sellers veterinarian for review.
•The breeders/ Seller’s veterinarian must concur that the puppy/dog died of a GENETIC/ HEREDITARY condition, and no other causes, beyond a doubt.
Should the French Bulldog become ill or unsound, any and all costs of treatment will be the responsibility of the Buyer(s). All warranties are for replacement only and not for refund of purchase price, in whole or in part, not for reimbursement of medical/ veterinary expenses, in whole or in part, unless otherwise specified.
HEALTH EXCLUSIONS:
The buyer acknowledges that the French Bulldog breed DOES have common health concerns inherent in the breed. These include, but are not limited to: patellar luxation, elongated soft palate, stenotic nares, Von Willebrands disease, entropian, distichiasis, intervertebral disc abnormalities, and allergy difficulties. The buyer assumes all responsibility and future subsequent treatment for any and all health problems discovered after the initial veterinary exam. At no time will financial restitution be made to a buyer for health problems incurred with their French Bulldog.
If the Buyer is ever charged or convicted of animal abuse, cruelty, or neglect by any city, town, township, village, county, state, federal agency, or the American Kennel Club, or is charged with violating any AKC rule or regulation, the Buyer forfeits all rights to the above named puppy/ dog and will immediately remand custody and ownership to the Seller, accompanied by all papers and records of the puppy/ dog. The Buyer shall not receive any monies, refunds, credits, or replacements from the Seller. In the event that the Seller must contact or retain an attorney, law enforcement, or the American Kennel Club to enforce this contract, any and all expenses incurred shall be paid by the Buyer, including court fees, and travel expenses. Should the Buyer choose to break any of the above portions of this contract, the remainder of the contract will be considered null and void, and Seller will have the right to repossess the puppy/ dog with no consideration of refund, replacement animal, or credit to the Buyer. If this occurs, the Buyer shall immediately relinquish all rights of owner and possession, including all AKC paperwork, to the Seller.
The above portions are not meant as a means for the Breeders/ Sellers to garner any additional profit of this French Bulldog from the Buyer(s), but as a deterrent and penalty for any abuse or neglect the dog may suffer at the hands of the Buyer(s). As the Breeders/ Sellers we would hope that the Buyer(s) show as much concern and well being for the dog as we do ourselves. We would hope that the Buyer(s) always remember that this dog is meant to be a pet and companion for the Buyer(s). If cared for and loved properly this French Bulldog will provide years of loyalty, companionship, and joy to the Buyer(s). We as the Breeders/ Sellers would wish for it to be no other way.
Entire Agreement
This agreement and release constitutes the entire agreement between Breeders/ Sellers and the Buyer(s), and shall not be modified, except by written notice to that effect, and accepted and signed by Breeders/ Sellers and Buyer(s). No oral statements of any person shall modify or otherwise affect the terms and provisions of this agreement.
This agreement shall be governed by, and construed in accordance with the laws of the state and county the Breeders/ Sellers shall reside in at the time any dispute may arise, and remedied in that location as well.
All parties have read and understand the terms of this agreement.
